Vaccine accidents

During the late 1970s and early 1980, there was an increase of litigation filed against pharmaceutical companies arising from the administration of vaccines.  Hence, in 1986, Congress enacted the National Childhood Vaccine Injury Act and created the National Vaccine Injury Compensation Program (VICP), a no-fault alternative to the traditional tort system.

According to the U.S. Supreme Court, “vaccine manufacturers fund from their sales an informal, efficient compensation program for vaccine injuries.  In exchange, they avoid costly tort litigation and the occasional disproportionate jury verdict.”

Vaccine injury claims are litigated in Vaccine Courts which are within the U.S. Court of Federal Claims.   You must retain an attorney who is duly licensed to practice law before the U.S. Court of Federal Claims to initiate any such vaccine injury claims.

Compensation can be based on a “table” injury under the National Childhood Vaccine Injury Act:  Vaccine Injury Table or by direct proof.  If your child’s injury is not listed under the Vaccine Injury Table, you must retain an expert to prove that the injuries you are alleging are causally related to the vaccines your client received in addition to proving that the damages sustained were due to those injuries.

The Vaccine Injury Compensation Trust Fund provides funding for the National Vaccine Injury Compensation Program to compensate vaccine-related injury or death petitions for covered vaccines on or after October 1, 1988.     The Vaccine Injury program is funded by a $.75 excise tax on vaccines recommended by the Centers for Disease Control and imposed on each dose (i.e. disease that is prevented) of a vaccine.   Trivalent influence vaccine for example, is taxed $.75 because it prevents one disease; measles-mump, rubella vaccine, which prevents three diseases, is taxed $2.25.
