pedestrian accidents

According to the Centers for Disease Control and Prevention, 5,977 pedestrians were killed in 2017 in traffic crashes in the United States.  That is about one death every 88 minutes.

Additionally, an estimated 137,000 pedestrians were treated in emergency rooms for nonfatal crash-related injuries in 2017.   Pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.

The most obvious defense of motor vehicle driver in a pedestrian accident is that he/she never saw the pedestrian.   Another common defense is that the pedestrian “darted out” in front of the motor vehicle.  Frequently, insurance company will retain an expert to analyze the perception and reaction time as to how quickly a driver can react and respond to a pedestrian who darts in front of their motor vehicle.  It is important that you retain an attorney who has the experience in countering this defense.
